gpn11 NOTICE OF SALEUNDER POWER GEORGIA, LOWNDES COUNTY Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by Max Ward to Farmers & Merchants Bank dated September 28, 2007 and recorded in Deed Book 3267, Page 177, Lowndes County, Georgia deed records conveying the after-described property to secure a Note in the original principal amount of ONE MILLION SIX HUNDRED FORTY-SIX THOUSAND SIX HUNDRED ELEVEN & 53/100 DOLLARS ($1,646,611.53), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Lowndes County, Georgia, within the legal hours of sale on the first Tuesday in October 2015, the following described property: TRACT IAll that tract or parcel of land situate, lying and being in Land Lot 131 of the 11th Land District of Lowndes County, Georgia, more particularly described as that certain 5.006 acre tract depicted upon a map or plat of survey thereof recorded in Plat Record Book 20, Page 37, Public Records of Lowndes County, Georgia, to which map or plat and the record thereof reference is hereby made for all purposes of description. Said property is known and designated as 4609 Bemiss Road, Valdosta, Georgia and is designated as Parcel Number 0145D 004 according to the Lowndes County Assessors Office. Less and Except 0.134 acres, more or less, as shown on that Right of Way Deed to Lowndes County, Georgia, dated February 21, 2000, recorded in Deed Book 1828, Page 143, in the Office of the Clerk of Superior Court of Lowndes County, Georgia. TRACT IIAll that tract or parcel of land situate, lying and being in Land Lot 1 in the 11th Land District and Land Lot 1 in the 12th Land District of Lowndes County, Georgia, and being 31.718 acres and being more particularly described as Tract Four as depicted on that certain map or plat of survey entitled Survey Prepared for Conner Ward dated November 14, 1997 and recorded in Plat Cabinet A, Page 572, in the Public Records of Lowndes County, Georgia, said recorded plat is by reference incorporated herein for all purposes in aid of description. Said property is known as 5545 Scruggs Circle, Hahira and is designated as Map Number 0067 083 according to the Lowndes County Assessors Office. The debt secured by the said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.
